Terms and Conditions: Hardie® Plank Challenge UK 2024
1. Scope of application:
These Terms and Conditions apply to the "Hardie® VL Plank challenge " (hereinafter referred to as the
Challenge). The
organiser is James Hardie Building Products Limited (hereinafter referred to as the Organiser) with its registered office at One, Fleet Place, London, EC4M 7WS.
2. Eligible participants:
1. Eligible participants must be natural persons of at least 18 years of age and be the owner or an employee of a construction business.
2. Eligibility is limited to registered trained installers - with the exception of the persons named in section 2.2.
3. Excluded from participation are (a) employees of the Organiser or its dealers and their first and second-degree relatives and (b) anyone who is directly or indirectly professionally involved with the Challenge, including their first and second-degree relatives.
4. The Organiser reserves the right to exclude from participation any persons for whom there are reasonable grounds to believe that they are using unauthorised means to participate or are otherwise attempting to gain advantages for themselves or third parties through manipulation.
3. The Challenge:
1. In order to participate in the Challenge, eligible participants must
a. provide the required personal details;
b. unconditionally accept and comply with these Terms and Conditions; and
c. accept the data protection provisions of the Organiser (https://jameshardie.de/de/datenschutz)
2. The Organiser will at each training event allow each person who has taken part in the product knowledge training, to take part in the Hardie® Plank Challenge (hereinafter referred to as the
Competitors). The detailed rules of the Challenge are set out in a separate document, which can be found here and will be available at every training event.
3. The Competitor with the fastest time at each training event receives a JBL speaker.
4. Every participant providing they have consented to, will be added to the National Leaderboard where the top three fastest installers will win a prize to the values: 1st - £5000, 2nd - £3000, 3rd - £2000. Details of the prizes can be found on www.hardieplankchallenge.co.uk
5. Competitors need to wear safety kit.
6. Training event needs to be a sanctioned James Hardie training organised by the Organiser and run by a James Hardie technical manager.
7. In the event of a breach of these conditions, the Organiser reserves the right to exclude participants from the Challenge.
4. Prizes
1. Each winner is responsible for ensuring that they are able to accept and use the prize.
2. The winner accepts and agrees that once they have received the prize, they will be responsible for any further costs or taxes associated with the prize.
3. Prizes cannot be paid out in cash – there is NO CASH ALTERNATIVE.
4. A prize cannot be exchanged for another prize. Each prize is personal and non-transferable. The winner declares that he/she will not sell or offer a prize for sale or for any commercial or promotional purposes (including the auctioning of prizes, for example on an internet auction platform), either himself/herself or through a third party.
5. Each prize is indivisible and can only be accepted in the form in which it was offered.
6. The Organiser reserves the right to change or withdraw a prize. Any prize offered instead will have at least the same or a higher value than the original prize.
7. Prizes will be announced to the winners on Thursday 31st October 2024.
8. Prizes that are not claimed by Friday 22nd November 2024, for whatever reason remain the property of the Organiser. This also applies in the event that a prize is rejected.
9. The manufacturer of the "JBL speaker" is solely responsible for the quality of the goods. In the event of defects in the goods, the Organiser shall be solely liable in accordance with the applicable statutory provisions.
5. Data protection provisions:
1. By taking part in the Challenge, all participants agree that the Organiser may process their personal data (in particular company name, name and e-mail address) provided in the context of this Challenge in order to determine a winner during the event.
2. Furthermore, all participants give their consent to be informed by the Organiser and other affiliated companies by e-mail about current products and services of the Organiser and other affiliated companies within the Group.
3. Furthermore, all participants give their consent to provide their details to a 3rd party to be entered into the UK National Hardie® Plank Challenge leaderboard, and for collection of prizes.
4. If participants wish to exercise their right to withdraw their consent at any time or their right to information regarding the personal data stored about them, they can contact the following e-mail address:

6. Severability clause
Should any provision of these Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these Terms and Conditions.
7. Applicable law / disputes:
1. These Terms and Conditions and their interpretation shall be governed by the laws of England and Wales. All disputes arising out of or in connection with these Terms and Conditions shall in the first instance be submitted to and resolved by the competent courts in London, United Kingdom, provided that this does not hinder or affect the entrant's right to initiate legal proceedings before other competent courts with applicable mandatory law. The Organiser reserves the right to amend these Terms and Conditions at any time without incurring any liability to the participants or third parties. An amended version of these Terms and Conditions will be published on the website. The amended Terms and Conditions shall become effective if the participant does not object to them. The Organiser will indicate this on the website.
2. The Organiser will conduct the Challenge in accordance with the applicable law. Complaints or questions regarding these Terms and Conditions and the Challenge can be addressed to the Organiser in writing.
